Viral Sach – संयुक्त किसान मोर्चा गुरुग्राम के अध्यक्ष एवं जिला बार एसोसिएशन गुरुग्राम के पूर्व प्रधान Chaudhary Santokh Singh ने कहा कि सुप्रीम कोर्ट द्वारा लखीमपुर खीरी कांड के मुख्य अभियुक्त और केंद्रीय गृह राज्य मंत्री अजय मिश्र टेनी के बेटे आशीष मिश्र की जमानत रद्द कर देने से किसानों और देश की जनता में न्याय व्यवस्था के प्रति फिर उम्मीद जगी है।
गत 3 अक्टूबर को हुए इस जघन्य हत्याकांड में शुरु से ही अपराधियों को बचाने की कोशिश चल रही थी और बार-बार सुप्रीम कोर्ट के दखल देने से ही न्याय मिल पाया है। इस आदेश के बाद अब अजय मिश्र टेनी के केंद्रीय मंत्रिमंडल में बने रहने का कोई औचित्य नहीं बचा है।
चार किसानों और एक पत्रकार को केंद्रीय मंत्री के बेटे द्वारा दिनदहाड़े रोंदने का यह नृशंस मामला पूरे देश में कानून के राज की एक कसौटी बन चुका है। शुरू से ही सरकार किसी भी तरह मंत्री और उसके बेटे को बचाने पर अमादा है और इस केस में बार-बार संवैधानिक मर्यादा और कानूनी प्रक्रिया की धज्जियां उड़ाई गई हैं।
इस हत्याकांड से पहले 26 सितंबर को खुद मंत्री अजय मिश्र टेनी ने खुलेआम किसानों को धमकाया था, लेकिन आज तक उस पर कोई कार्यवाही नहीं हुई है।दिनदहाड़े किसानों पर गाड़ी चढ़ाने के बाद भी सुप्रीम कोर्ट की फटकार मिलने तक मुख्य अभियुक्त आशीष मिश्रा की गिरफ्तारी नहीं हुई थी।
इलाहाबाद हाई कोर्ट ने आश्चर्यजनक जल्दबाजी दिखाते हुए बिना पीड़ित पक्ष को सुने 10 फरवरी को अभियुक्त को जमानत दे दी। हाई कोर्ट ने राजनैतिक रूप से ताकतवर अभियुक्त द्वारा गवाहों पर असर डालने की पक्की संभावना पर विचार नहीं किया, बल्कि किसान आंदोलन पर गैर वाजिब टिप्पणियां की। आशीष मिश्र को जमानत मिलने के बाद इस कांड के दो प्रमुख चश्मदीद गवाहों पर हमला हुआ।
जज की निगरानी में काम कर रही SIT द्वारा लिखित सिफारिश करने के बाद भी उत्तर प्रदेश सरकार ने हाई कोर्ट के निर्णय के विरुद्ध अपील दायर नहीं की।अंततः मृतक किसानों के परिवारों को ही सुप्रीम कोर्ट का दरवाजा खटखटाना पड़ा।
इस संदर्भ में सुप्रीम कोर्ट का फैसला एक ऐतिहासिक नजीर बन सकता है। इस फैसले से उम्मीद बनती है कि अब इस हत्याकांड में संविधान और कानून की मर्यादा के हिसाब से दोषियों को सजा दिलाई जाएगी।
संयुक्त किसान मोर्चा यह याद दिलाना चाहता है की आज भी इस हत्याकांड में घायल हुए कई किसानों को मुआवजा नहीं मिला है और इस हत्याकांड के चश्मदीद गवाहों पर हमले जारी हैं। इस कांड में फसाए गए चार किसान आज भी हत्या के आरोप में जेल में बंद हैं और उनकी जमानत की अर्जी पर विचार भी नहीं हुआ है। स्थानीय स्तर पर आज भी मंत्री अजय मिश्र टेनी और उनके परिवार का आतंक कायम है।
सुप्रीम कोर्ट के फैसले ने फिर से यह स्पष्ट कर दिया है कि अजय मिश्र टेनी का केंद्रीय मंत्रिमंडल में बने रहना इस मामले की निष्पक्ष जांच और न्याय के रास्ते में सबसे बड़ी बाधा है। इस आदेश के बाद इस जघन्य हत्याकांड के सूत्रधार का देश के गृह राज्य मंत्री बने रहने का कोई औचित्य नहीं बचता है। इसलिए संयुक्त किसान मोर्चा एक बार फिर यह मांग करता है कि अजय मिश्र टेनी को केंद्रीय मंत्रिमंडल से बर्खास्त किया जाए।

Even after the farmers were run over in broad daylight, the main accused Ashish Mishra was arrested till the reprimand from the Supreme Court. Didn’t happen.
The Allahabad High Court, showing surprising haste, granted bail to the accused on February 10 without hearing the aggrieved party. The High Court did not consider the sure possibility of the politically powerful accused influencing the witnesses, but made inappropriate comments on the farmer’s movement. After Ashish Mishra was granted bail, two prominent eyewitnesses of the incident were attacked.
The Uttar Pradesh government did not file an appeal against the High Court’s decision even after the SIT, working under the supervision of a judge, made a written recommendation. Ultimately, the families of the deceased farmers had to approach the Supreme Court.
In this context, the decision of the Supreme Court can become a historical example. This decision gives hope that now the culprits will be punished in this murder case according to the dignity of the constitution and law.
United Kisan Morcha wants to remind that even today many farmers who were injured in this massacre have not received compensation and the eyewitnesses of this massacre are being attacked. The four farmers implicated in this case are still in jail on the charges of murder and their bail applications have not even been considered. The terror of Minister Ajay Mishra Teni and his family continues even today at the local level.
The Supreme Court’s decision has again made it clear that the continuation of Ajay Mishra Teni in the Union Cabinet is the biggest obstacle in the way of fair investigation and justice in this case. After this order, there is no justification left for the mastermind of this heinous massacre to continue as the Home Minister of the country. That’s why United Kisan Morcha once again demands that Ajay Mishra Teni be sacked from the Union Cabinet.
