Viral Sach – गुरुग्राम – वाटर बॉडी एवं गैरमुमकिन पहाड़ की जमीन पर Nagar Nigam द्वारा पेट्रोल पंप के लिए आवंटन मामले में साइट पर हलचल होने से डीएलएफ क्षेत्र के निगम पार्षद आरएस राठी ने मुख्यमंत्री समेत वन विभाग हरियाणा सरकार व पर्यावरण, वन एवं जलवायु मंत्रालय भारत सरकार को पत्र लिखकर आवंटन रद्द करने की मांग की है।
इसकी शिकायत सचिव, वन विभाग हरियाणा, पर्यावरण मंत्रालय, प्रधान सचिव अर्बन लॉकल बॉडी, उपायुक्त व नगर निगम आयुक्त, प्रदूषण नियंत्रण बोर्ड को भी भेजी है।
पार्षद आरएस राठी द्वारा लिखे पत्र में बताया कि अर्बन लॉकल बॉडी के प्रधान सचिव ने इंडियल ऑयल कोरपोरेशन लि0 को मार्च 2019 में डीएलएफ फेज-1 के पीछे चकरपुर गांव की पुरानी वाटर बॉडी और जंगल की जमीन में से 1500 वर्ग मीटर जमीन इंडियल ऑयल कंपनी को पेट्रोल पंप के लिए आवंटित कर दी है।
जिसका मासिक किराया 2.25 लाख रुपये निर्धारित किया है। अब मौके पर हलचल होने से पार्षद के अलावा सामाजिक सस्थाएं, क्षेत्र की आरडब्लूयूए भी इसके विरोध में उतर आई है। बताया जा रहा है कि गुरुग्राम के कई विभागों ने एनओसी भी जारी कर दी है। यदि वन क्षेत्र में पेट्रोल पंप लगता है तो यह इलाका पूरी तरह बर्बाद हो जाएगा।
राठी का कहना है कि यह जमीन डीएलएफ फेज-1 के पीछे स्थित ई, एफ ब्लॉक व शिव नादर स्कूल के पीछे से निकल रही है और यह चौक खुशबु चौके के नाम से जाना जाता है जो कि आगे जाकर सीधा सनसेट बोलवर्ड रोड पर मिलता है। यदि इस प्रकार से सरकार व निगम घने जंगलों को उजाड़ेंगे तो शहर में पर्यावरण की ओर भी भयावह स्थिती बनेगी।
मौके पर विकसित हुआ तालाब और ट्रैक
नगर निगम-जीएमडीए ने आईएम गुरुग्राम संस्था के साथ मिलकर लाखो रुपये खर्च कर यहां पर पुराने तालाब का जीर्णोद्वार करने व लोगों के घूमने के लिए ट्रैक विकसित करने का काम पूरा कर लिया है। पौधारोपण अभियान के तहत काफी पौधे भी लगाए गए। राजस्व रिकार्ड के हिसाब से भी इस जमीन का खसरा गैरमुमकिन पहाड़ दर्शाया गया है जहां भी कोई भी गैरवानिकी कार्य नहीं किया जा सकता।
उच्च न्यायालय के आदेश- नहीं हो सकता गैरवानिका कार्य
यह जमीन वन क्षेत्र का हिस्सा है और इस जमीन व आस-पास के क्षेत्र को लेकर याचिका हरिन्द्र धींगडा बनाम यूनियन ऑफ इंडिया याचिका के फरवरी 2020 के स्पष्ट आदेश है कि यहां पर कोई गैरवानिकी कार्य नहीं हो सकता।
वनविभाग ने नहीं दी एनओसी
कई विभागों से एनओसी मिलने के बीच वनविभाग ने इसके लिए एनओसी जारी नहीं की क्योंकि यह जमीन वन क्षेत्र का हिस्सा है इसलिए इसकी अनुमति केवन पर्यावरण एवं वन मंत्रालय भारत सरकार की हाइ पावर्ड कमेटी ही दे सकती है। जिसके लिए जुलाई 2020 में वन विभाग ने एजेंसी द्वारा आनलाइन आवेदन करने को लेकर उपायुक्त को पत्र लिखा था।
मेरी तरफ से मुख्यमंत्री समेत तमाम संबंधित विभागों को पत्र लिखा गया है। यदि 15 दिन के भीतर आवंटन रद्द नहीं हुआ तो मजबूरन हमे कोर्ट का दरवाजा खटखटाना पड़ेगा।

Pond and track developed on the spot
The Municipal Corporation-GMDA together with the IM Gurugram organization has completed the work of renovating the old pond here and developing a track for the people to roam by spending lakhs of rupees. Many saplings were also planted as part of the tree plantation drive. According to the revenue records also, the measles of this land has been shown as an impossible mountain where no non-forestry work can be done.
High Court orders – Cannot be non-violent work
This land is part of the forest area and there is a clear order of February 2020 of the petition Harindra Dhingda vs Union of India regarding this land and the surrounding area that no non-forestry work can be done here.
Forest Department did not give NOC
In the midst of getting NOC from many departments, the Forest Department did not issue NOC for this because this land is part of the forest area, so only the High Powered Committee of the Ministry of Environment and Forests, Government of India can give its permission. For which in July 2020, the Forest Department had written a letter to the Deputy Commissioner regarding the agency to apply online.
A letter has been written on my behalf to all the concerned departments including the Chief Minister. If the allotment is not canceled within 15 days, then we will be forced to approach the court.
